You’ve arrived at our Terms and Conditions page of the website. We have put together the below Terms and Conditions for transparency purposes. If you do decide to continue using our website, you are agreeing to comply with the terms below.

  1. Terms of Use

We at Mindful and Co Kids reserves the right to modify the terms below from time to time. If we do this, a date stamp will be applied at the top of the page therefore it is important that you check this page regularly.

  • Cookies and Links

Our website uses cookies to collect information monitor browsing preferences. These are files that a site or its service provider will use to transfer to your computer’s hard drive through your web browser (if you opt-in and allow) so that sites or service provider systems are able to recognise your browser, and remember certain information.

We do use Cookies for the purposes of tracking our advertisement spend and compile data and interactions related to traffic to our site. No personally identifiable information are collected through cookies, and you have the right to disable cookies through the website browsers.

Please note however, that disabling this function may mean some of the features on our Website not work as well as intended. You can still speak with us about our services or products by calling us on the phone.

In terms of links, you acknowledge that our website, including associated social media profiles, may contain links to third party websites. The inclusion of a link does not imply that we at the Mindful and Co Kids endorses, has investigated or verified the linked websites. We make no warranty or representation concerning these links or the linked websites and you agree that we are not responsible for the functionality of these links, the security of such websites, the reliability or accuracy of the information contained on such websites, the copyright compliance, legality, decency, privacy policy, privacy practices or any other aspect of such websites.

If you do enter any third party websites, you acknowledge that you do so at your own risk (and your responsibility to review any terms of use or privacy policies relevant to such websites).

Information collected via SMS opt-in will not be sold, rented or shared.

  • Payments

Payment of our products will be in United States Dollars (USD) inclusive of any sales taxes and full and upfront payment of your purchase must be made before we can dispatch your order. Actual price charged is dependent on the delivery charges and/or exchange rate applied. For customers outside of the United States, you will be liable for any import duty or other taxes, fees and charges applicable by customs or other authorities in the country of receipt. If you are unsure whether this is applicable to you, we do recommend that you contact your local tax or custom authority. 

The payment gateway we use Airwallex. We do reserve the right to amend and/or change the pricing and rates at any given time.

  • Deliveries

Products purchased from Mindful and Co Kids will be transported either through a courier company as chosen by Mindful and Co Kids. Please do note that delivery addresses cannot be altered once an Order has been processed. An order has been processed once payment has been made.

While we will make every reasonable effort through our packaging and our liaisons with our delivery services to ensure that your parcel is safe for transportation and arrives to you safely, you acknowledge that ownership of the parcels turned over t a courier company engaged by us transfers to the buyer. We will not be responsible for any loss, or damage to packages and will not be responsible for any errors in the supply of incorrect shipping information, or delivery errors through our delivery partners. 

If the product that you have ordered from Mindful and Co Kids is in stock at the time your order is accepted, this will be processed within 1-2 business days. 

The estimated delivery time-frame will range between 2-5 days. Please note however, this is an indication only. At certain times of the year, it can go beyond this, therefore we recommend allowing up to 7 business days for delivery. To ensure the safe delivery of your product(s), we recommend that someone is available to receive your order. 

In circumstances where no one is present to receive the delivery (unless an authority to leave is provided), the courier will return your order to the nearest post office, or depot for collection, causing a potential delay in your delivery.  Where authority to leave is opted in by the client, you agree that the parcel is deemed as received when left at your premises.

  1. Cancellations and Refunds

All products purchased from Mindful and Co Kids are final (unless the product ordered and received arrives in a damaged state, and it was a fault from us) are sold on a no return or credit basis once an order has been completed, and payment has been processed.

Pursuant to relevant Consumer Laws, where a product has been listed at an incorrect price, incorrect description or image due to typographical error or similar oversight, we do reserve the right to cancel and/or amend a transaction.

If a product ordered and received arrives in a damaged state, please ensure you get in touch with us within seven (7) days to let us know via returns@mindfulandcokids.com.au(please note, Mindful and Co Kids would require photo evidence and information from you to assess the refund request). If on assessment, it was a fault from us, a refund or a replacement will be provided. Any requests for cancellations or refunds not specified above will be at the sole discretion of Mindful and Co Kids, and will be assessed on a case by case basis. Such refunds will be exclusive of any postage and handling costs.

  1. Intellectual Property

The information, recipes, blogs, text materials, graphics, logos, button icons, video and audio clips, trade marks (whether registered or not), advertisements, layout, arrangement, graphical user interface, look and feel, and control features of Mindful and Co Kids’ Website and or any of its Platforms are protected by copyright, trademark and other intellectual property laws. If images from Mindful and Co Kids are shared on social media platforms including but not limited to Pinterest, Instagram or Facebook, they must be credited and linked back to us.

You may not modify, rent, lease, loan, sell, distribute or create derivative works based on any of the Product(s), Content (either in whole or in part) unless you have been specifically told that you may do so by Mindful and Co Kids.

  1. Liability

In no event shall we be liable to you or anyone for any delays, errors, any loss, damage or cost, including, without limitation, any direct, indirect, special, purely economic, consequential or punitive damages or any legal costs arising out of, or in connection to the use of information provided by you, you not being able to access Mindful and Co Kids for any reason, or the use of our products.

You indemnify us against any action, liability, claim, loss, damage, proceeding or expenses(including legal costs) suffered or incurred arising out of, or in connection with your breach or non-observance of any term of these Terms and Conditions.

Products sold through Mindful and Co Kids (as well as our suppliers) will include a clearly specified nutrition or ingredients information panel which will outline allergen statements as well as contain a detailed listing of all ingredients foreach product. We will not be held liable to you or anyone for omitting to read and fully acknowledge the detailed ingredients list specified for each of the product(s) available.It is presumed that purchases of products are done so, after understanding and acknowledging the ingredients in the product(s).

Your purchase of our products means you will take full responsibility for the proper use, storable and maintenance of these goods. 

  1. Disputes and Mediation

If you do have a complaint about your experience or product received, please contact us directly through jacqueline@mindfulandcokids.com.au. Mediation will be the first cause of action, if communications between us in an attempt to resolve the dispute has exhausted. All legal/mediation/arbitration fees associated with a dispute raised by the Client will be at the expense (in full) of the Client.

  1. Choice of Law

The agreement herein is governed by the law in force in the United States of America and you any other courts which may hear appeals from those courts in respect of any proceedings in connection with these Terms of Conditions.If any of these Terms and Conditions are invalid or unenforceable, they may be struck out and the remaining Terms of Use will continue to be of full force and effect.

  1. Law enforcement

We reserve the right to cooperate fully with any law enforcement authority in any jurisdiction in respect of any lawful direction or request to disclose the identity or other information in respect of anyone posting any materials, which violate any applicable or relevant law.

Mobile Terms of Service

The Mindful And Co Kids USA mobile message service (the "Service") is operated by Mindful And Co Kids USA (“Mindful And Co Kids USA”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Mindful And Co Kids USA’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Mindful And Co Kids USA through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Mindful And Co Kids USA. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to MindfulAnd or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Mindful And Co Kids USA mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
